(Extract from letter outlining BBC Resources proposal on Working Time Directive. Received by BECTU February 16)
"b) In Resources Directorate - most staff on hours conditions, but not all, are already covered by agreements which provide either time off or a penalty payment if you work more than 12 hours in a day and receive a break of less than 10 hours between turns of duty. If the 52 week reference period is accepted the agreements on working 12 hours in a day would not change, but management has indicated that they would be prepared in principle to extend the 10 hours to 11 hours. Compensatory rest for infringing 11 hours between duties would be given as time off during hours which would normally be worked instead of payments or comp leave. In those areas of Resources where there is no agreement on 10s & 12s, management has agreed to discuss implementing this new arrangement for less 11 hours between duties. As the Directive is there to improve quality of life then the compensatory rest must be taken and cannot be bought out.
If one day off in seven or two days off 14 fourteen is not given and you have received overtime payments for working those days, then compensatory rest will be provided but will not be paid time. Further discussions would be held regarding conditions under which compensatory rest may be given at a time when you would otherwise have worked i.e. paid time.
If these proposals are acceptable in principle, then talks would be held with Resources management to discuss implementation locally. The aim would be to conclude the talks within 3 months."
