Part-timers pensions access

Part-timers can potentially claim access to company pension schemes as a result of a legal decision.

A recent landmark decision in the European Court of Justice has opened the possibility of successful claims by part-timers for access to company pension schemes. The effect of the decision - which is on preliminary points of the relevant test cases - is that:

  • part-timers can potentially claim back-dated access to April 1976;
  • the time limit for presenting a claim to a Tribunal is likely to be six months from the end of employment;
  • however, pending the final decision on the test cases, it may still be possible for individuals who have left more than six months ago, to make claims.
  • BECTU's solicitors Thompsons, have devised a questionnaire and explanatory note for any members considering whether to make a claim.

Completed forms will be forwarded to Thompsons in order that a claim can be lodged with the Tribunal if the applicant wishes.

It is particularly important to claim within 6 months of leaving employment if at all possible.
